Jet's Pizza operates an online food ordering platform through the Site pizzajets.click, through which customers may browse our menu, customize food and beverage selections, place orders for pickup or delivery, and complete payment transactions. Our services include, but are not limited to, the following:

• Online ordering of freshly prepared pizzas, sides, beverages, and related food products;
• Menu browsing, including nutritional and allergen information where available;
• Secure online payment processing for orders;
• Order tracking and confirmation communications via email or SMS;
• Customer account creation and management;
• Promotional offers, loyalty programs, and discount codes (subject to separate terms);

We reserve the right at any time to modify, suspend, or discontinue any aspect of our services, including but not limited to availability of menu items, delivery zones, hours of operation, and promotional programs, with or without notice. Availability of menu items is subject to change without prior notice and may vary by location, time of day, or supply availability. We do not guarantee the continuous availability of any specific product.

3. User Obligations and Prohibited Activities

We reserve the right to accept or decline your order for any reason, including but not limited to unavailability of products, inability to obtain authorization for payment, or identification of pricing errors.

Order confirmation via email or SMS does not constitute our final acceptance of your order. We reserve the right to cancel orders at any time prior to preparation and delivery/pickup, in which case we will provide a full refund.

5.2 Pricing

All prices displayed on the Site are in U.S. Dollars (USD) and are subject to change without notice. Prices do not include applicable taxes or delivery fees unless otherwise stated. Applicable sales tax will be calculated and displayed at checkout based on the delivery or pickup address and the applicable tax jurisdiction.

We make every effort to ensure that pricing information displayed on the Site is accurate. In the event of a pricing error, we reserve the right to cancel the order and issue a full refund, or contact you to confirm the order at the correct price.

5.3 Payment

We accept major credit cards, debit cards, and other payment methods as indicated on the Site at the time of checkout. All payment transactions are processed through secure, third-party payment processors. We do not store your complete credit card or financial account information on our servers.

By providing payment information, you represent and warrant that you are authorized to use the payment method, that the payment information is accurate and complete, and that you authorize us to charge the applicable amount to your payment method.

In the event that payment is declined or cannot be processed, your order will not be fulfilled, and you will be notified accordingly.

5.4 Refunds and Cancellations

Due to the perishable nature of food products, all sales are generally final. Refunds or replacements may be issued at our sole discretion in cases of incorrect orders, food quality issues, or failed deliveries. Delivery availability, delivery times, and delivery zones are subject to change and may vary based on your location, time of day, weather conditions, staffing, and other factors. We do not guarantee specific delivery times and shall not be liable for delays.

For pickup orders, it is your responsibility to collect your order within a reasonable time after receiving your pickup-ready notification. We are not responsible for order quality degradation resulting from delayed pickup.

Risk of loss or damage to food products passes to you upon delivery to the delivery address or upon pickup at the designated location.

7. Intellectual Property Rights

All content on the Site, including but not limited to text, graphics, logos, images, photographs, audio and video clips, digital downloads, data compilations, software, and the overall look and feel of the Site (collectively, "Content"), is the property of Jet's Pizza or its content suppliers and is protected by applicable United States and international intellectual property laws, including copyright, trademark, and trade dress laws.

The Jet's Pizza name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Jet's Pizza or its affiliates. You may not use such marks without the prior written permission of Jet's Pizza. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site solely for your personal, non-commercial use. You may not:

• Reproduce, distribute, display, sell, license, or otherwise exploit any Content for commercial purposes without our express written consent;
• Modify or create derivative works based on the Content;
• Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices;

Any unauthorized use of the Content may violate copyright law, trademark law, laws of privacy and publicity, and communications regulations and statutes.

To the extent our Site permits the submission of reviews, comments, photos, or other user-generated content ("UGC"), you grant Jet's Pizza a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, and fully sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such UGC in any and all media.

You represent and warrant that you own or otherwise control all of the rights to the UGC you submit, and that such UGC does not infringe the rights of any third party. We reserve the right to remove any UGC at any time for any reason without notice.

While we make every effort to provide accurate allergen and nutritional information, our food products are prepared in shared kitchen environments where cross-contamination with common allergens — including but not limited to gluten, dairy, nuts, soy, and shellfish — may occur. We cannot guarantee that any menu item is completely free of any specific allergen.

Customers with food allergies or dietary restrictions are strongly encouraged to contact us directly before placing an order to discuss their needs. Jet's Pizza shall not be liable for allergic reactions or adverse health effects resulting from the consumption of our food products.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States of America and applicable state law, without giving effect to any choice or conflict of law provisions. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the applicable state, and you waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

These Terms shall also be interpreted in accordance with applicable federal consumer protection laws, including the Federal Trade Commission Act, 15 U.S.C. § 41 et seq., as amended. Where applicable, the laws of the state in which our principal place of business is located shall apply.

Nothing in this section shall limit our ability to seek injunctive or other equitable relief from any court of competent jurisdiction in any situation where we believe that such relief is necessary or appropriate to protect our interests.

16. Dispute Resolution

16.1 Informal Resolution

Before filing any formal legal action, you agree to attempt to resolve any dispute with us informally. We will attempt to resolve the dispute informally within thirty (30) calendar days of receiving your notice. If the dispute is not resolved within that period, either party may proceed with formal dispute resolution.

16.2 Binding Arbitration

Except for claims for injunctive or other equitable relief and except as otherwise specified in these Terms, any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration before a single arbitrator.

The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The arbitration shall be conducted in the English language. The arbitrator's award shall be final and binding.

16.3 Class Action Waiver

YOU AND JET'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Jet's Pizza agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

16.4 Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.

17. Term and Termination

These Terms shall remain in full force and effect while you use the Site and our services. We reserve the right, in our sole discretion, to:

• Terminate or suspend your access to all or part of the Site for any or no reason, including for any violation of these Terms;
• Terminate or cancel any order at any time prior to fulfillment, for any reason;
• Discontinue the Site or any portion thereof at any time without notice.

Upon termination, your right to use the Site and services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

19. Severability

If any provision of these Terms is held by a court of competent jurisdiction or an arbitrator to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary such that the remaining provisions of the Terms will continue in full force and effect. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, which shall remain in full force and effect.

Furthermore, in lieu of each invalid or unenforceable provision, a valid and enforceable provision shall be substituted which comes as close as possible to the economic intent and purpose of the invalid or unenforceable provision.

20. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Site, shall constitute the entire agreement between you and Jet's Pizza concerning your use of the Site and our services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Site.

No waiver by Jet's Pizza of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Jet's Pizza to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

21. Force Majeure

Jet's Pizza shall not be liable or responsible to you, nor be deemed to have defaulted under or breached these Terms, for any failure or delay in fulfillment or performance when and to the extent such failure or delay is caused by or results from acts beyond our reasonable control, including but not limited to: acts of God, flood, fire, earthquake, pandemic, epidemic, governmental actions, war, invasion or hostilities, terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, explosion, embargoes, or strikes, labor stoppages or slowdowns or other industrial disturbances, or shortage of adequate power or transportation facilities.

These Terms are for the sole benefit of the parties hereto and their respective successors and permitted assigns, and nothing herein, express or implied, is intended to or shall confer upon any other person or entity any legal or equitable right, benefit, or remedy of any nature whatsoever under or by reason of these Terms.
